1) Delivery: If the courier has attempted to deliver your item and has left a card you must contact the couriers direct. If the delivery is refused for any reason then you will be liable both for the original delivery and the subsequent return costs. If we have had an item returned due to non communication on your part, incorrect /incomplete address You will be responsible for the original delivery ,return delivery and the subsequent return to you costs.                                                           

1a) Delivery: - Is available across mainland UK for most of our products. there may be a small charge for delivery. We are currently not able to deliver all our products to the Scottish Highlands please phone or e mail before you order 01482 214 744, we do not deliver any products to Ireland, Channel Islands or anywhere outside of mainland UK. Orders are usually dispatched within 1-7 working days, however in busier periods please allow up to 14 working days on certain products to be dispatched.  please ensure that someone is available to sign for the goods upon delivery as the delivery firms we use will not leave products without a Signature. THE HAPPY HUTCH COMPANY makes every effort to ensure products arrive in perfect condition.You should examine your goods thoroughly for any damages or shortages before signing the delivery note, as replacements can only be issued when the delivery note is signed ‘damaged’. Damages where the delivery note is signed for as ‘received in good condition’ will assume to have occurred when the risk has passed.  However, in the unlikely event of a product arriving damaged in any way, customers should contact THE HAPPY HUTCH COMPANY  by telephone or e-mail within 24hrs of delivery we will then arange to have it picked up and returned to us . THE HAPPY HUTCH COMPANY will either send a replacement product or replacement items.This does not include Bargain Basement.

2) Guarantee: - The stated guarantee is 1 month = 4 weeks on our British happyhutch own made products this covers any defects which arise from poor design, workmanship or manufacturing faults. Products are not covered against; general wear and tear, misuse in any way, any type of modifications, poor maintenance, or any un-authorised repairs. Please note that due to some products being manufactured out of raw materials, it is possible they could contain natural defects, for example; knots cracks and splits in the wood . small crack and splits sometimes will be seen around the nails and staples this is beyond our control and can happen in transit with movment in the wood , Any swelling due to adverse weather conditions will not be construed as a defect and therefore will not be covered by the guarantee. Should your goods develop a fault, you are responsible for returning the goods to us. Should it be deemed the fault has not occurred through poor workmanship, design or manufacturing fault, you the customer will be responsible for the cost of us returning the goods to you. You must pay these costs before your goods are released. Should the fault occur due to poor workmanship, design or manufacturing fault we will be responsible for the cost of returning the goods to you with any defect rectified,The guarantee on  and all imported products sold by the happyhutch company has a 1 week = 7 days guarantee on all of this type of products .This does not include Bargain Basement we do not give a guarantee on anything out of this categorie.

2a)Maintenance: - In order to keep your purchase in the best possible condition you should adhere to the following recommendations:

  • Hutches should be situated in a sheltered area to shield from wind, rain and sun.
  • Hutches should be re-treated with an animal safe wood preservative on a yearly basis.
  • In adverse weather conditions we recommend that hutches are covered with a weather proof covering. phone Val on 01482 836 303

3) Guarantee of Quality: - THE HAPPY HUTCH COMPANY guarantees that all British happyhutch made products contained in our products are of the highest quality. Occasionally certain items may be unavailable at the last minute in which case we may provide a substitute . Whilst we try to avoid this happening, we guarantee that the item provided will be of at least equal quality and value, and will be as close to the original item as possible. This does not include Bargain Basement.

3A) Goods: - All sizes, weights and dimensions are approximate and are for guidance only. Please note that all dimensions are measured externally. Although our website is updated regularly, the Happy Hutch Company  reserves the right to alter product specifications without notice.

4) Payment Options: - THE HAPPY HUTCH COMPANY accepts all major credit and debit cards (£15 minimum) and uses a secure online payment system, WorldPay, which has been developed in association with the NatWest Bank PLC.

5) Credit Card Security: - We know of no documented cases of credit card fraud using our shopping system over the Internet. All credit card numbers are encrypted in the software when the order is placed using 2048 bit encryption systems. They are not held in clear text on any web site.

6) How To Cancel An order: If you (the customer) wish to cancel an order please contact us as soon as possible. We will then cancel your order and issue a full refund

 within 7 working days. If you choose to cancel between despatch and delivery, please contact us and reject the order upon delivery attempt. upon receipt of the order we will issue a full refund

The 35% administration and re stocking fee is also applicable to orders we have to cancel due to cutomer error

as we pay the delivery charge for you ,we do not charge you for delivery , if you then cancel your order and we have sent it out , you will be charged the delivery fee , this fee depends on the product you have purchased  

                              

6a) Returning items :We do our best to provide the most accurate descriptions of the items we sell. Should you decide you want to return an unused item to us, contact us first by phone 01482 214 744 and let us know, you must then send Confirmation in Writing to get to us within 11 days of you receving the goods , we will try our best to offer alternate goods, a store credit or a refund.  please ensure the item is in the original packaging and is unused.Providing the goods have been returned in acceptable condition a full refund will be issued

Excluding a 35% administration and re stocking fee

.The Happy Hutch Company will refund the customers money within 30 days of cancellation.Excluding a 35% administration and re stocking fee,These terms and conditions do not affect your consumer's statutory rights.This does not include the Bargain Basement products.

As the products in the Bargain Basement category are at a reduced price and are sold as seconds there is a 58% administration and re stocking fee payable if those products are returned to us .  

 

6b) Non Delivery of items: If for any reason out of our control items are not received by the customer by post, please contact us where we will investigate the matter with the relevant delivery company. If items are lost/delayed in the post we will send out the replacement goods within the timeframe arranged between us and the customer. Should the lost/delayed goods arrive before or during a new despatch date please inform us as soon as possible. If the lost or delayed items sent by post arrive after replacement items are sent, please  refuse delivery of the goods.

7) Refunds: Refunds for valid claims will be made via the same method of payment as used to place order.

8) Retention of Title: This remains with THE HAPPY HUTCH COMPANY until the goods are paid for in full.

9) Responsibility for Local Taxes & Duties: These are the responsibility of the shopper or recipient in the country of destination. VAT is included within the prices shown for each item.

12) Order Confirmations: Upon submitting an order using our automated shopping basket system, with payment made through the secure payment gateway servers, you will receive two e-mails. An 'Order Confirmation' from THE HAPPY HUTCH COMPANY and a 'Transaction Authorized' receipt. If you submit an order requesting payment by any other method you will receive an 'Order Confirmation' once payment has been made.

13) Stock Levels: We now make most of our products to order we do not stock all products.

14) Confirmation of Despatch: Confirmation of despatch of orders will not be sent unless specifically requested.

15) Invoices: Paper invoices are available upon request.

17) Data Protection: THE HAPPY HUTCH COMPANY does not sell to anyone its database of customers and information contained on customers remains confidential to the company. We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and secondly, to provide you with the best possible service. We will not e-mail you in the future unless you have given us your consent. 18) Substitutions: Whilst every effort will be made to supply the items as specified, the product materials used are subject to availability and may change from time to time. THE HAPPY HUTCH COMPANY reserves the right to substitute items of similar or higher value, where appropriate, should the need arise.

20) Unforeseen Circumstances: While every effort will be made to meet shoppers demands, cancellations or variations may be necessary as a result of Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of THE HAPPY HUTCH COMPANY.

21) If you have a complaint, please contact us immediately by e-mail to info@happyhutch.co.uk or by phone - UK - 01482 214744 and International - Telephone +44 1482 214744. All complaints will be acknowledged within one working week. Any complaint will be dealt with fairly, effectively and confidentially. These complaints will be dealt within ten working days. These terms and conditions do not affect your consumer's statutory rights.

22)Consumer law   These terms and conditions shall be governed by and construed in accordance with English Law and EU Law and you hereby agree to be subject to the jurisdiction of the Courts of England.

We guarantee to meet our obligations under the consumer protection laws currently in force including:

The Sale of Goods Act 1979;
The Supply of Goods and Services Act 1982;
The Consumer Credit Act 1974;
The Trade Descriptions Act 1968;
The Unfair Contract Terms Act 1977 and the 1994 Regulations; and
The Consumer Protection Act 1987.

We promise to meet the conditions of the Data Protection Act 1984. We will never send the consumer third-party marketing material, or pass the consumers details to others.
 

Acceptance - Placing of an order indicates acceptance of these terms and conditions. In the event of any conflict then these terms and conditions shall prevail, and shall override any terms and conditions that the customer my attempt to impose. Any conditions of contract which the customer my attempt to impose shall form no part of the contract between the customer and the Happy Hutch Company. These terms and conditions replace any previous ones and are the only ones to apply in a business conducted between the Happy Hutch Company and the customer. 10/12/2007
